These Terms of Service ("Terms") govern your access to and use of the Strikekit websites, applications, agent software, and related services (collectively, the "Services"). Strikekit is a product of Gloocan Technologies Pvt Ltd ("Gloocan", "we", "us", or "our"). By creating an account or using the Services, you agree to these Terms with Gloocan Technologies Pvt Ltd.

1. Eligibility and Accounts

You must be at least 16 years old and able to form a binding contract to use the Services. You are responsible for the accuracy of account information, safeguarding credentials, and all activity under your account or organization. Notify us promptly of any unauthorized use.

2. Organizations and Access

If you use the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms. Organization administrators control member access, roles, and configurations within their tenant. You are responsible for ensuring users under your organization comply with these Terms.

3. Subscriptions and Billing

Paid plans are billed according to the pricing and billing cycle shown at purchase or in your account. Fees are generally non-refundable except where required by law or expressly stated otherwise. We may change prices with reasonable notice; continued use after the effective date constitutes acceptance of the new pricing. Failure to pay may result in suspension or termination of access.

4. License and Acceptable Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for your internal business purposes. You agree not to:

• Reverse engineer, decompile, or attempt to extract source code except where permitted by law
• Circumvent security, access controls, usage limits, or billing mechanisms
• Use the Services to violate laws, infringe rights, or distribute malware
• Probe, scan, or attack our systems or other users without authorization
• Resell, sublicense, or provide the Services to third parties except as expressly allowed
• Misrepresent your identity or affiliation, or abuse support channels

5. Customer Content

You retain ownership of content, test data, configurations, and materials you submit to the Services ("Customer Content"). You grant us a limited license to host, process, and display Customer Content solely to provide and improve the Services. You represent that you have the rights needed to submit Customer Content and that it does not violate applicable law or third-party rights.

6. Agent Software and Local Environments

Where you install Strikekit agent software or run tests in local or customer environments, you are responsible for configuring and securing those environments, including network access and secrets. You remain responsible for systems the agent interacts with and for compliance with your internal policies.

7. Third-Party Services

The Services may integrate with third-party products (for example issue trackers, cloud providers, or payment processors). Your use of those products is governed by their terms. We are not responsible for third-party services we do not control.

8. Intellectual Property

Gloocan Technologies Pvt Ltd and its licensors own all rights in the Services, including software, branding, documentation, and related intellectual property. These Terms do not transfer ownership of our intellectual property to you. Feedback you provide may be used by us without obligation to you.

9. Confidentiality

Each party may receive confidential information from the other. The receiving party will use reasonable care to protect that information and use it only for purposes related to the Services, except where disclosure is required by law.

10. Disclaimers

The Services are provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components.

11. Limitation of Liability

To the maximum extent permitted by law, Gloocan Technologies Pvt Ltd and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business opportunities. Our aggregate liability arising out of or related to these Terms or the Services will not exceed the amounts you paid us for the Services in the twelve (12) months before the claim.

12. Indemnification

You will defend and indemnify Gloocan Technologies Pvt Ltd against claims arising from your Customer Content, your use of the Services in violation of these Terms, or your violation of applicable law or third-party rights.

13. Suspension and Termination

You may stop using the Services at any time. We may suspend or terminate access if you breach these Terms, create risk or legal exposure, or fail to pay fees when due. Upon termination, your license ends and we may delete or disable access to Customer Content according to our retention practices, subject to applicable law.

14. Changes to the Services or Terms

We may modify the Services and these Terms from time to time. We will post updated Terms on this page and revise the "Last updated" date. Material changes may also be communicated by email or in-product notice. Continued use after changes become effective constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws applicable in the jurisdiction where Gloocan Technologies Pvt Ltd is incorporated, without regard to conflict-of-law principles, unless mandatory local consumer protections apply. Courts in that jurisdiction will have exclusive venue for disputes, except where prohibited by law.
